We begin your lawsuit by filing a Complaint in Circuit Court and then serving the defendant through either the sheriff's office or a private process server depending on how easy it is to find the defendant.
After the lawsuit is filed and served on the defendant, the defendant will then file an Answer in which they will either admit or deny the allegations in our lawsuit. The parties will then go through the discovery process.
Once the parties are served, discovery begins. This process allows each side to ask the other side what evidence they have to support or refute their claims and it also allows each side to determine the strength of the other side's claims and defenses. After initial discovery is completed, we can then move to party depositions.
A deposition is a procedure in which each side is allowed to ask the other side questions. During a deposition, the attorneys will be present to object; however, the attorneys may not lead their clients in their answers or provide their answers for them. This is an opportunity for each side to see how the other side presents and it also allows them to test the other side regarding different issues--both legal and factual.
